Wills ● Trusts

Executing a will or a trust is a practical decision that can save families time, money, and conflict in the future. Proper planning through wills and trusts ensures that an individual's wishes are documented and will be carried out following his or her death.

At Wilson, Bellamy, Brown & Wilson, we help individuals draft wills and trusts that will protect their assets, property, and families following their death. Since each client has different needs and goals, our estate planning services are provided to address their one-of-a-kind needs.

Wills

A will (or last will and testament) is a legal document that addresses how an individual wants an estate handled following his or her death. If an individual dies without a will, his or her estate will be handled by the State. Following death, a will is validated through the process of probate.

A will typically addresses the following:

  • Guardianship of children
  • Property division
  • Heirs and beneficiaries
  • Funeral and burial preferences

Trusts

Unlike a will where estate administration is handled after someone's death, a living trust allows individuals to manage their property and assets while they are still living. Individuals can transfer their property into a trust during life, and changes can be made (revoked) at any time. After death, an appointed "trustee" manages the trust, pays taxes, and distributes property as designated in the trust. A trust allows families to avoid probate.
